PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 2nd respondent Police to issue Non-Traceable Certificate to the petitioner in respect of the petitioner's missing original documents viz., Settlement Deed in Doc.No.1502/2010, dated 20.09.2020 and Sale Deed in Doc. No. 1464/2010 dated 22.09.2010 on the file of the Singampuneri SubRegistrar, Sivagangai District based on the petitioner's complaint dated 26.05.2023.

O R D E R
This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the 2nd respondent Police to issue NonTraceable Certificate to the petitioner in respect of the petitioner's missing original documents viz., Settlement Deed in Doc.No.1502/2010, dated 20.09.2020 and Sale Deed in Doc. No.1464/2010 dated 22.09.2010 on the file of the Singampuneri Sub-Registrar, Sivagangai District based on the petitioner's complaint dated 26.05.2023.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

The learned counsel appearing for the petitioner would submit that the petitioner has given complaint dated 26.05.2023, before the respondent for missing of his Settlement Deed in Doc.No.1502/2010, dated 20.09.2020 and Sale Deed in Doc. No.1464/2010 dated 22.09.2010 on the file of the Singampuneri Sub-Registrar, Sivagangai District, but no action was taken as on date and hence, she has also sent a representation to the respondents on 28.06.2023.

4. The learned Additional Public Prosecutor appearing for the respondents would submit that the petitioner's complaint dated 26.05.2023 as well as the representation dated 28.06.2023 are pending.

Considering the above, the respondent police is directed to conduct enquiry and complete the same by following the circular issued by the Director General of Police within a period of three months from the date of receipt of a copy of this order. Depending upon the outcome of the enquiry, the petitioner shall workout his remedy through appropriate proceedings.
