ORDER
This Criminal Original Petition has been filed to direct the Additional Mahila Court, Dindigul District to expedite the committal proceedings in PRC No.75 of 2021 in Crime No.375 of 2019 on the file of the first respondent within the time stipulated by this Court.

The learned counsel appearing for the petitioner would submit that the petitioner is the defacto complainant in this case and based on the complaint given by her a case has been registered in Crime No.375 of 2019 for the offences under Sections 174 of Cr.P.C., The marriage between the daughter of the petitioner namely Manopriya and the second respondent was solemnized in the year 2017 and thereafter the daughter of the petitioner/ wife of the second respondent went along with the second respondent to USA. Thereafter the second respondent demanded huge amount as dowry and also harassed the daughter of the petitioner. In the meantime, on 02.07.2019 when the petitioner was at Dubai she received a call from the second respondent that his daughter committed suicide , therefore the petitioner lodged complaint before the police officers that her daughter committed suicide and she was forced to commit suicide by the 2/5
second respondent and other accused persons who are the family members of the second respondent. Thereafter First Information Report has been registered and charge sheet also filed and the same is pending before the Additional Mahila Court, Dindigul in PRC No.75 of 2021, thereafter there is no progress in this case, thereby the present petition has been filed.
3. When the matter is taken up for hearing there is no representation on behalf of the second respondent.
4. This Court earlier called for report from the concerned Judicial Magistrate about the status of case and the learned Magistrate has also filed a status report. As per the status report Non Bailable Warrant is pending as against A1 and thereby the case is still pending at the stage of committal.
5. Considering the limited scope of prayer sought for in this petition and also considering the long pendency of case, it is appropriate to direct the learned Judicial Magistrate, Additional Mahila Court, Dindigul to expedite the committal proceedings . Though Non Bailable Warrant is pending as against A1, the case can be split up in accordance with law by 3/5
following the procedures and the case can be committed to the Sessions court with regard to other accused.

In view of the same, this Criminal Original Petition stands allowed and the learned Judicial Magistrate, Additional Mahila Court, Dindigul is directed to expedite the committal proceedings as indicated above as early as possible without causing any delay preferably within a period of two months from the date of receipt of a copy of this order. 03.06.2026 NCC : Yes/No Index : Yes / No Internet : Yes / No aav To
