ORDER

This Writ Petition is filed to issue a Writ of Mandamus to direct the respondents to consider the Petitioner's representation dated 27.08.2025, for granting permission to celebrate the Vinayagar Chaturthi procession from "Arulmigu Shri Siddhi Vinayagar Temple to Mankatti Thepakkulam, Melur" and immersion of the Vinayagar Idol.

2. It appears that in an earlier writ petition in W.P(MD)No.24423 of 2025 filed by the 6th respondent herein, in which the petitioner herein was the 8th respondent, this Court vide order dated 10.09.2025 had disposed of the said writ petition on the following terms:

"The case on hand pertains to the affairs of the petition~mentioned temple. I suggested to the counsel on either side to agree for a consent order. Accordingly, based on the consent of the writ petitioner and the eighth respondent, this writ petition is disposed of on the following terms:

(a) The petition~mentioned temple will be kept open for public worship from 07.00 am to 09.00 am and 06.00 pm to 08.00 pm on all days.

(b) The petitioner shall ensure that at any given point of time, four functional CCTVs will be kept installed.

(c) Since the temple is meant for worship of the general public, during Vinayagar Chaturthi and Iyyappan season, the devotees are entitled to utilise the temple premises for religious activities. The petitioner-s prior permission shall be sought and it shall be given. The organisers must undertake before the petitioner that when the activities are concluded, the temple premises should be litter~free and the temple properties do not suffer any damage.

(d) It is further undertaken that the main gate will be kept open. The key will be with the writ petitioner. He shall open the main gate at 07.00 am and lock the same at 08.00 pm. The jurisdictional police are called upon to keep a watch to ensure that no illegal activity takes place inside the temple premises.

(e) The petitioner also states that the private respondents can remove the idol of Vinayagar installed in the temple premises for visarjan purpose. (f) This arrangement is subject to any decree 3/6

that may be passed by the jurisdictional civil court or authority under the Tamil Nadu Hindu Religious and Endowments Act.

No costs. Consequently, connected miscellaneous petitions are closed."

3. The learned counsel for the 6th respondent also confirms the compromise and would submit that this arrangement would be subject to any decree that may be passed by the jurisdictional civil Court or authority under the Tamil Nadu Hindu Religious and Endowments Act.

4. In view of the order dated 10.09.2025 passed by this Court in W.P(MD)No.24423 of 2025, no further directions are necessary in this writ petition. Hence, this Writ Petition is disposed of. No Costs. 17.09.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No PJL To
