PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent Nos.1 and 2 to conduct Survey and demarcate the boundaries of the petitioner's land situated in S.No. 109/9 Allur Village, Kaalaiyar Kovil taluk, Sivagangai District in Patta No. 2180 as per her Challan dated 22.04.2025 and to provide adequate police protection for fencing his lands within stipulated time framed by this Court. ORDER

Since action was not taken to conduct the survey, in spite of the petitioner submitting an application seeking such survey, the present writ petition has been filed.

2.The petitioner relies on registered sale deed bearing document No.1229 of 2020 in her favour and the patta issued to her in respect of the land bearing survey No.109/9 of an extent of 0.54.00 ares. 3.The petitioner has joined two private parties as the third and the fourth respondents in the writ petition. The petitioner has also placed on record the order dated 18.10.2024 dismissing the civil suit filed by the third respondent. It is stated that an application to restore such suit is pending. After putting the third and the fourth respondent on notice, the first and the second respondents shall verify whether the suit has been restored and, if so, take no further action on the application until disposal thereof. On the contrary, if such civil suit has not been restored, the official respondents may proceed further with the application for survey. In view of this direction, notice to the private respondents is dispensed with in this writ petition. 2/4

4.Accordingly, this writ petition is disposed of by directing the first and second respondents to take action on the petitioner's application for survey after putting the petitioner, the third respondent, the fourth respondent and the owners of the neighbouring lands, if any, on notice. If necessary, the official respondents may take the assistance of the jurisdictional police authority. No costs.
