ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 406, 506(ii) and 420 of I.P.C., in Crime No. 1641 of 2019 on the file of the respondent police, seek anticipatory bail.
3. The defacto complainant states that she had advanced a sum of Rs.15,00,000/- to the petitioners herein. The learned counsel for the petitioners states that they received only a sum of Rs.10,00,000/- from the defacto complainant. The petitioners give a further undertaking that the said amount will be repaid within a period of one year. This undertaking is taken on record. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.19025 of 2019 4.Be that as it may, I am of the view that this is not a case in which the arrest of the petitioners will serve any purpose.
5. In the view of the above, I am inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.VI, Madurai, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
