Heard the learned counsel on either side.

2. The petitioner seeks issuance of individual / separate patta in respect of the petition mentioned survey numbers.

3. I called upon the learned Special Government Pleader to produce the relevant revenue records. The petitioner's name is figuring as joint pattadar only in respect of survey Nos.162/2A, 164/3A and 114/2. The revenue records as regards survey No.146/1A has not been produced.

4. When a person's name appeared as joint pattadar, he can apply to the authority for issuance of separate patta provided he is able to establish his case. The third respondent cannot keep the application pending indefinitely. The third respondent is directed to conduct enquiry after issuing notice to all the interested persons and pass order on merits and in accordance with law within a period of four months from the date of receipt of a copy of this order.

5. This writ petition stands disposed of accordingly. No costs.
