The petitioner, an accused in S.C.No.371 of 2018, on the file of the learned Assistant Sessions Judge, Sankarankovil, Tenkasi District was found guilty by the trial Court and was convicted and sentenced as under:- 1/5

The petitioner has also moved this application to suspend the sentence imposed on him by the trial Court.

2. The case of the prosecution is that on 15.09.2017, at about 14.05 hours, in a wedding function, the petitioner attacked PW2 with sickle and abused PW2 in filthy language. Hence, the case.

3. The learned Government Advocate (Crl. Side) appearing for the respondent Police submits that the petitioner is a history sheeted rowdy, who is involved in five previous cases, out of which, two ended in conviction. He therefore, prayed for dismissal of this petition. 2/5

4. Considered the rival submissions and perused the materials placed before this Court.

5. Though the learned counsel appearing for the petitioner has raised some grounds in support of the petitioner, considering the antecedents as pointed out by the learned Government Advocate (Crl. Side) that the petitioner is a history sheeted rowdy convicted in Crime No.157 of 2022 on the file of the Sankarankoil Town Police Station and Crime No. 358 of 2022 on the file of the Sivagiri Police Station and that there are other cases pending as against this petitioner, this Court is not inclined to suspend the sentence for the present.

6. Hence, this Criminal Miscellaneous Petition is dismissed. 24.03.2026 (2/2) mbi 3/5
