This appeal has been filed to set aside the judgement of acquittal passed by the learned Judicial Magistrate, Fast Track Court, Srivilliputtur, made in S.T.C.No.14 of 2011, dated 04.08.2011. 2.The learned counsel for the appellant reported no instructions from the appellant even for the past so many hearings. It is seen that the 1/3

appellant has failed to instruct his counsel and also failed to appear before this Court. It shows that the appellant has not interested to pursue with the case, since the appeal is against the acquittal for the offence under Section 138 of the Negotiable Instrument Act. 3.In view of the same, this Criminal Appeal stands dismissed for default.
