Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the proceedings in Rc.No.M1/21757/2012 dated 10.03.2017 on the file of the third respondent herein and to quash the same and consequently direct the respondents jointly and severally to pay the petitioner the sum of Rs.10,84,023.15 towards transport charges together with interest at such rate as may be determined by this Honble Court from 04.07.2012 till the date of payment and also to direct the respondents to pay the petitioner further transport charges.

When the matter is came up for hearing today, it is represented by the learned counsel for the petitioner that in spite of their efforts to contact the relatives of the petitioner for filing substitution petition, they could not get any instructions in respect thereof.

2. Since the writ petition was filed by Mr.C.Damodharan as the proprietor of M/s. N.K.R. Periana Nadar & Co., and he is said to have passed away, with no substitution petition having been filed, the writ petition is dismissed as having abated.
