ORDER
Heard both sides.
2.The petition mentioned land was purchased by the writ petitioner herein in the year 2006. Patta was also mutated in his name. Subsequently, vide two sale deeds dated 20.08.2009, the petitioner sold the same in favour of Thiru.Rahul Sarath, a minor child. These documents were registered as Document Nos.1788 of 2009 and 1789 of 2009 on the file of the second respondent. Subsequently, both the documents were cancelled on 21.04.2010 vide Document Nos.3218 and 3219 of 2010. Any property standing in the name of a minor cannot be alienated or dealt with without getting prior permission from the 2/5
jurisdictional civil Court. In the meanwhile, Thiru.Rahul Sarath in whose favour the sale deeds dated 20.08.2009 were executed attained majority. The petitioner herein has joined hands with the said Rahul Sarath and executed a general power of attorney dated 18.08.2025 in favour of one T.Ashokan, who is none other than the writ petitioner's brother. The said power of attorney has been kept as a pending document. The second respondent has informed the petitioner that a decision regarding registration will be taken after getting clarification from the first respondent. The writ petitioner is not right in labelling the said communication as a refusal check slip.
3.Be that as it may, I am satisfied that since the petitioner has executed the power of attorney along with Thiru.Rahul Sarath, the registering authority cannot raise any objection. In this view of the matter, the second respondent is directed to register the power of attorney dated 18.08.2025 and release the same subject to the fulfilment of the other usual formalities.
