ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 420, 465, 468 and 471 of IPC, in Crime No.173 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant purchased the subject property from A1. Thereafter, A1 is said to have dealt with the same property along with the other ancestral properties and settled the same in favour of

the petitioners who are his sons. Subsequently, on a complaint made to the District Registrar, the settlement deed was also cancelled through proceeding dated 21.08.2023.

3. Heard the learned counsel on either side and perused the materials placed on record.

4. Taking into consideration the facts and circumstances of the case and also considering the fact that the entire case is borne out by records and may not require any custodial interrogation, there shall be a direction to the respondent police to resort to the procedure under Section 35 of BNSS. The investigation shall be completed as expeditiously as possible.
