ORDER

This Criminal Original Petition is filed for transfer of investigation in Crime No.219 of 2025 from the file of the second respondent to the third respondent.

2. The main grievance of the petitioner is that the FIR was initially registered against the petitioner's husband, who is a victim; that thereafter, on the complaint given by the petitioner, the FIR was registered against the driver of a lorry, which was involved in the accident; that the said lorry was not identified; and that the driver was not arrested.

3. The learned Additional Public Prosecutor, on instructions, would submit that the lorry has now been seized; that the driver was identified, arrested and released on bail; and that the investigation is at the advanced stage.

4. In view of the aforesaid submission, there is no reason to transfer the investigation. However, the second respondent shall conduct the investigation in a fair manner and file a final report within a period of two (2) months from the date of receipt of a copy of this order.
