Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent Nos.1 to 4 to forbearing the respondent Nos.5 to 10 and their men from carrying out the Sonaiyya Temple Constructional activities at S.No.86, Melanettur Group, Veladimadai Village, Manamadurai Taluk and further direct the respondent Nos.1 to 4 to ensure that the petitioner along with other villagers, is permitted to take part in Sonaiyya Temple construction by affording their temple tax and allowed to worship without any discrimination or hindrance and under the supervision of the appropriate authorities.

O R D E R

This Writ Petition has been filed seeking a direction to respondent Nos.1 to 4 to forbear respondent Nos.5 to 10 and their men from carrying out the Sonaiyya Temple construction activities at S.No.86, Melanettur Group, Veladimadai Village, Manamadurai Taluk, and further to direct respondent Nos.1 to 4 to ensure that the petitioner, along with other villagers, is permitted to take part in the Sonaiyya Temple construction 2/5

by paying the temple tax and to worship without any discrimination or hindrance, under the supervision of the appropriate authorities.

2. After hearing both sides, it appears that the temple is being constructed jointly by both groups of villagers.

3. Since the construction has already been commenced, if at all the petitioner's rights are aggrieved in any manner, the petitioner is at liberty to approach the competent Civil Court for appropriate relief. This Court is not inclined to entertain the writ petition in view of the disputed questions involved, and the petitioner is granted liberty to work out his remedy before the Civil Court.

4. In view of the above, this Writ Petition is accordingly dismissed. No costs. Consequently, the connected miscellaneous petitions are closed.
