Respondents Prayer:- Writ petition filed under Article 226 of Constitution of India, seeking for a Writ of Mandamus directing the Respondents to consider the representation of the Petitioner dated 07.03.2016 for cancellation of Patta in respect of S.No.6/1B36A in Alampatti Village, Kovilpatti Taluk issued in the name of Tamil Nadu Housing Board and thereafter, issue joint Patta in the name of the Petitioner and his brother within a time frame as fixed by this Court.

O R D E R

The Third Respondent has filed Counter-Affidavit dated 23.03.2018, stating that the land in Survey No.6/1B 36A having an extent of 2.79.5 hectares has been acquired in the year 1991 for the Tamil Nadu Housing Board and that the compensation amount of Rs.16,82,745/- has been deposited with the Sub Court, Thuthukudi in the year 1994. In view of the same, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition and he has also made an endorsement to that effect, which is recorded.

Accordingly, the Writ Petition is dismissed as withdrawn. This would not, however, preclude the right of the petitioner to workout his remedies before the proper forum for any other relief that he may otherwise be entitled under law. No costs.
