ORDER

Heard both sides.

2.The petitioner has filed O.S.No.30 of 2024 on the file of Sub Court, Devakottai for the relief of declaration and partition. The respondents 6 and 7 herein are figuring as D25 and D26 in the said suit. The petitioner apprehends that the respondents 6 and 7 herein may further alienate the subject property. In order to restrain the registering authority from entertaining any document from them, this writ petition has been filed.

3.When the petitioner has filed a civil suit and the respondents 6 and 7 herein are very much figuring as the defendants therein, any grievance with respect to the subject property can be appropriately addressed before the civil Court. The petitioner can as well obtain an interim order from the civil Court itself. The petitioner undertakes before this Court to file an Interlocutory Application in this regard within ten days. It is open to the petitioner to implead the registering authority in 3/6

the Interlocutory Application alone without making them a defendant in the main suit. The said Interlocutory Application will be disposed of by the Court below on merits and in accordance with law within a period of four weeks thereafter.

4.The fourth respondent herein is directed not to register any document to be presented by the respondents 6 and 7 till the end of October 2025. I have not gone into the merits of the respective claims. It is for the jurisdictional civil Court to take a call in this matter. 5.This writ petition is disposed of accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
