Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the records pertaining to the impugned order passed by the third respondent in Na.Ka.No.T. 4/15773/30/2016, dated 19.07.2016, and quash the same and consequently direct the respondents to reimburse medical expenses of Rs.1,42,918/- to the petitioner within a time frame to be be stipulated by this Court.

The petitioner's request for reimbursement of medical expenses incurred by him for the treatment of his father has been rejected under the impugned order, dated 19.07.2016, passed by the third respondent.

2. The petitioner was a Sub Inspector of Police and his father had suffered from serious illness and therefore, he had to incur medical expenses for the treatment of his father. He had sought for reimbursement of the medical expenses from the respondents and the same has been rejected under the impugned order of the third respondent, on the ground that he is not entitled to claim Rs.1,42,918/- towards reimbursement of medical expenses and the maximum permissible amount that can be granted under the Tamil Nadu Police Benevolent Fund Scheme is Rs.15,000/- only.

3. As seen from the circular, dated 06.12.2010, issued by the first respondent, the parents of the Police personnel are not included under the Benevolent Fund Scheme. Admittedly, the petitioner has not challenged the

Tamil Nadu Police Benevolent Fund Scheme, which excludes the parents of the Police personnel from getting any financial assistance for medical treatment on account of life threatening diseases and denies the Police Personnel to get reimbursement of the expenses incurred by them for the medical treatment of their parents. Without challenging the said Scheme, which does not give benefit for the reimbursement of medical expenses incurred by the Police personnel to the treatment of their parents, the question of challenging the impugned order, dated 19.07.2016, passed by the third respondent, does not arise.

Therefore, this writ petition is disposed of by granting liberty to the petitioner to challenge the Tamil Nadu Police Benevolent Fund Scheme, which excludes the parents of the Police personnel from getting any financial assistance for the medical treatment on account of life threatening diseases, in the manner known to the petitioner under law.
