For Respondent : Mr.A. Albert James, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1371 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 468 and 471 IPC and Section 4(1-A), 4(1)(a) of Tamil Nadu Prohibition Act, in Crime No.1371 of 2022 on the file of the respondent Police, seeks anticipatory bail.
2.The case of the prosecution, as per the de-facto complainant is that on receiving a secret information, the respondent police conducted vehicle check up on 14.11.2022 and at that time, the petitioner herein was illegally found in possession of 72 bottles of liquor (each containing 180 ML). Hence,the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and he seeks anticipatory bail. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.21804 of 2022 4.The learned Government Advocate (Crl.side) would submit that the petitioner is having two previous cases in similar nature and the investigation of the case is pending and hence, he strongly opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsel appearing on either side and perused the materials available on record. Taking into consideration the facts and circumstances of the case and that the petitioner is having two previous cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner with certain conditions.
