Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to release the petitioner by name Ammaniyammal, wife of Naganathan, aged about 66 years, now confining at Trichy special prison for women under premature release on the basis of the G.O.Ms.1155 Home (Pri IV) Department, dated 11.09.2008 or G.O.Ms.488, Home (Pri IV) Department, dated 15.11.2021 or under advisory board proceedings under rule 341 of the Tamilnadu Prison Rules or any other appropriate order or government scheme in accordance with law within the time stipulated by this Court. ORDER : This petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.ALAGUMANI, Advocate for the petitioner and of M/S.S.Ravi Additional Public Prosecutor for the respondents, this court made the following order:- (Order of the Court was made by J.NISHA BANU, J.) The writ petition is listed today under the caption 'for report'.
2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor, on instructions, submitted that subsequent to the order of this 2/4
Court, dated 02.11.2023, vide G.O(Ms)No.745 Home (Prison - IV) Department, dated 28.12.2023, the petitioner is released prematurely and a copy of the said Government Order is also produced before this Court.
