ORDER

This criminal original petition has been filed seeking direction to Judicial Magistrate, Thiruvaiyaru to dispose the case C.C.No.1 of 2021, within the time frame fixed by this Court.

2.The learned counsel for the petitioner submitted that on the date of retirement, the petitioner was placed under suspension and Disciplinary proceedings was initiated on the basis of the above said criminal case. Because of the above said case and the Disciplinary proceedings, he is unable to get his pensionary benefits.

3.The learned Additional Public Prosecutor submitted that even the matter is of the year 2021, now it has been taken regularly and PW1 was examined in Chief. Now the case was posted for examination of witnesses 2 to 5 on 03.01.2023.

4.In view of the submissions made by the learned Additional Public Prosecutor, there shall be a direction to the learned Judicial Magistrate, Thiruvaiyaru, to expedite the trial process in C.C.No.1 of 2021, pending on his file and dispose of the same within a period of five (5) months from the 2/4

date of receipt of a copy of this order.

5.With the above directions, this criminal original petition is disposed of.
