Heard Mr. M.S.Senthil Kumar, Learned Counsel for the Petitioner and Mr. D.Venkatesh, learned Standing Counsel for the Respondents and perused the materials placed on record, apart from the pleadings of the parties. 2.

The Writ Petition has been filed to direct the First Respondent to measure and fix vacant site tax for land in T.S.No.363 in ward No. 13, Muthuraman Street, Karaikudi.

Though the Learned Counsel for the Petitioner relies upon the Settlement Deed dated 04.10.2021 which has been registered as Document No.2402 of 2021 in the office of the Sub-Registrar, Karaikudi, to substantiate the title of the Petitioner to the property, it is evident from the communication dated 03.11.2022 sent by the First Respondent that no such document had been produced earlier for assessing tax for the said property. In that backdrop, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to make a fresh application along with relevant documents to the concerned authority and he has made 2/4

endorsement to that effect in the court record. In view of the same, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
