PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Declaration, declaring the action of the respondents in recovering a sum of Rs.1,23,900/- is unjust, illegal, arbitrary and unconstitutional and consequently direct the respondents to refund the recovered amount of Rs.1,23,900/- to him with interest at 18% per annum payable from 31.01.2020 to till the date on which the above amount are settled to him. ORDER

The instant Writ Petition has been filed by a retired employee of the respondent transport corporation, seeking a declaration to the effect that the recovery made by the respondents for un-implemented increment cut is illegal, arbitrary and unconstitutional.

2. A perusal of the records reveal that the second respondent has passed an order on 12.12.2018, seeking to recover a sum of Rs.1,23,900/- Unless the said order is challenged in a manner known to law. The prayer sought for by the writ petitioner cannot be granted.

3. In view of the above said facts, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. The petitioner is at liberty to challenge the order dated 12.12.2018, if he is so advised. 24.01.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No gvn 2/4
