Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to permit the petitioner vehicle bearing Registration No.PY 05 F 8778 to enter the Madurai City Roads for the purpose of fuel filling and approaching the authorised maintenance dealer for service purpose by considering the representation dated 03.12.2019. Heard the learned counsel on either side.
2.The petitioner is a stage carriage operator plying his omni bus. He wanted this Court to direct the respondents to permit him to enter the madurai city roads for the purpose of filling fuel and approach the authorised service centres located in the city. In this regard, the petitioner submitted his representation dated 03.12.2019.
3.As rightly pointed out by the learned Government Counsel appearing for the respondents, the prayer in the writ petition cannot be entertained. Integrated Mattuthavani bus stand was established only to decongest the city roads. The District https://hcservices.ecourts.gov.in/hcservices/ 1/2
WP(MD)No.26974 of 2019 Collector, Madurai has issued notification forbearing the Omni Buses from entering into the city limits. Therefore, an exception cannot be made for the petitioner alone. A number of petrol outlets have been located in the by-pass road and near the Mattuthavani bus stand also. There is no need to enter the city limit for the purpose of filling fuel.
4.The writ petition stands dismissed. No costs.
