ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 12.10.2024, for the offence punishable under Sections 8(c), 20(b)(ii)(B), 22 (a) of NDPS Act in Crime No. 498 of 2024, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that A1 and A2 were found in possession of 1200 grams of Ganja, 120 grams of Diazpam powder along with syringe. On investigation, it came to light that the petitioner had supplied the contraband to A1 and A2. The petitioner was arrested and remanded to judicial custody in this case on 12.10.2024.

3.The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner was already arrested in a case in Cr.No.531 of 2024, wherein, the petitioner is the accused and he was in possession of 200 grams of ganja. In that case also, the petitioner is in judicial custody and he has not been granted bail.

4.Taking into consideration of the facts and circumstances of the case and also considering the fact that the petitioner is repeatedly involved in similar offence and that the petitioner has not been granted bail in the other case, where he is the sole accused, this Court is not inclined to enlarge the petitioner on bail at this stage.
