PRAYER: Criminal Original Petition filed under Section 528 of BNSS praying to direct the second respondent to not to harass the petitioner and his family members under the guise of enquiry.

ORDER
This Criminal Original Petition has been filed to direct the second respondent to not to harass the petitioner and his family members under the guise of enquiry.
2. The petitioner has sent a representation on 28.10.2024 seeking to not to harass the petitioner by the second respondent in civil dispute between the petitioner and one Kandhasamy.
3. According to the petitioner the petitioner is tailor by profession having shop near Thirumalainaicker Mahal. His friend Andikaalai and Kandhasamy entered into real estate business and in the business there was some transactions and money was also transacted. Later it was not admitted that there was some dispute. The second respondent without any jurisdiction since knowing to Kandasamy had been harassing the petitioner and interfering in the petitioner's business and calling him for enquiry often and forcing him to settle the amount.
4. The learned Additional Public Prosecutor would submit that on the compliant of Kandasamy the petitioner and Andikaalai was called for 2/4
enquiry. The Andikaali, Kandasamy as well as the petitioner are involved in real estate business. There is some dispute in the real estate business. After enquiry the Kandasamy had given a letter that admitting that the dispute is civil in nature and he would approach the civil Court to redress his grievance, hence the complaint was closed. In view of the same, the petitioner is no more required for enquiry.
5. In view of the same, the Criminal Original Petition stands dismissed.
