ORDER : The Court made the following order :- The petitioner / A13, who was arrested and remanded to judicial custody on 22.09.2023 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 29(1) and 25 of NDPS Act, 1985 in Crime No. 374 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 09.05.2023 at about 7.15 hrs on secret information the respondent police conducted raid at Thoothukudi ring road near Hannah Jospeh Hospital, at that time they intercepted a car bearing Reg.No. TN 85 E 8763 and on search they found the petitioner along with other accused in illegal possession of 40 kgs of ganja and based on the confession statement of A2, 2050 kgs of ganja was found hidden in a godown.. Hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner was not present in the scene of 2/5

occurrence and no contraband was recovered from this petitioner and he has been arrested and remanded to judicial custody on 22.09.2023 Therefore, prayed to grant bail for the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would admit that the petitioner and other accused were found in illegal possession of 40 kgs of ganja and based on the confession statement of A2, 2050 kgs of ganja was found hidden in a godown which is a commercial quantity. He would further submit that the investigation is completed and charge sheet was filed and the offences are grave in nature and hence, he strongly opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions made by the learned counsel on either side, and considering the facts that the quantity of contraband involved in this case is commercial quantity and considering the fact this petitioner is having previous cases for similar kind of offence and already 3/5

the petition filed by the petitioner for bail was dismissed by this Court and there is no change in circumstances of the case to consider the present petition for bail and considering the fact in this case trial commenced and witnesses were also examined, this Court is not inclined to grant bail to the petitioner at this stage.
