The above petition has been filed seeking orders to condone the delay of 32 days in filing the appeal, challenging the award passed in M.C.O.P.No.1223 of 2014 dated 15.04.2024 on the file of the Motor Accident Claims Tribunal / Special District Court No.II to deal with MCOP cases, Tiruchirappalli.

2. Despite receipt of Court notice, the fourth respondent has not turned up.

3. The learned counsel appearing for the petitioner filed a proof of service showing that notice sent to the respondents 1 to 3 as well as to the counsel appearing for the respondents 1 to 3 before the trial Court came to be served.

4. Heard the learned counsel appearing for the petitioner.

5. Considering the reasons assigned and also the quantum of delay, this Court is inclined to condone the delay.

Accordingly, this petition is ordered and the Registry is directed to number the appeal, if it is otherwise in order and post the same on 01.06.2026.
