ORDER
[Order of the Court was made by The Hon'ble CHIEF JUSTICE] Heard the learned counsel appearing on either side.
2. The petitioner had taken loan from the respondent bank for the purchase of ECO Sports Car for own purpose. He could not repay the loan amount. The respondent re-possessed the vehicle.
3. The learned counsel for the bank submits that Rs.4,07,064/- is due and payable by the petitioner. If the petitioner pays the said amount, the vehicle can be released in his favour.
4. Considering the above contentions of the parties, we pass the following order:
(i) The petitioner shall pay Rs.2,00,000/-(Rupees Two Lakhs Only) with the respondent bank, within a period of six weeks from today;
(ii) On payment of Rs.2,00,000/- as directed above, the respondent bank shall release the vehicle to the petitioner;
(iii) The petitioner is bound to pay the remaining legitimate amount due and payable by monthly installments of Rs.25,000/-(Rupees Twenty Five Thousand Only); and (iv) In default of two continuous installments, the respondent bank will have a right to take action with regard to the vehicle and the loan account.
5. The writ petition is disposed of accordingly. No Costs. Consequently, connected miscellaneous petitions are closed. [S.V.G., C.J.] [L.V.G., J.] 30.11.2023 Index : Yes / No PM
