Prayer in WP(MD).No.27624 of 2025: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondent No.2 to permit the petitioner to retire on Medical Invalidation with effect from 17.02.2025 within the time stipulated by this Hon'ble Court and pass such further or other orders as this Hon'ble court may deem fit and proper in the circumstances of this case and thus render justice. W.P.(MD).No.25043 of 2025 is filed seeking direction to the 1st respondent to provide comprehensive revised medical report including the eye-examination in respect of the petitioner to the 2nd respondent.
2. The learned Counsel appearing for the petitioner would submit that the petitioner herein is one and the same in both the writ petition. The petitioner is working as Administrative Officer in the 2nd respondent municipal corporation. At the advice of doctors, he applied for medical leave on 17.02.2025 and also sought retirement on the ground of medical invalidation. He was also referred to medical board and the report from the medical board has still not been provided. Again, he was referred to medical board in the month of July 2025 and the medical report has not yet been provided to the petitioner. The petitioner had been suffering from the serious illness of seizure and he had contends that his application ought to have been considered and it has been unnecessarily been kept pending. Hence, he prayed this court to allow these writ petitions as prayed for by the petitioner.

3. Countering his argument, the learned Counsel appearing for the 2nd respondent would contend that he had been referred to the medical board which had given an opinion for neurological evaluation. However, the petitioner had not participated in the neurological evaluation, only when the comprehensive report is received from the board, action could be taken and before that, the claim of the petitioner cannot be entertained. Hence, he prays this Court to dismiss the writ petition.
4. I have carefully considered the submissions made on either side and perused the material available on record.
5. Admittedly, the petitioner had been referred to medical board and an interim report had also been issued by the medical board by referring the petitioner for neurological evaluation. Even before the medical evaluation, the petitioner has approached this Court with the aforesaid reasons. It is the case of the respondent that the petitioner must attend the neurological evaluation and only after such evaluation, a comprehensive report can be filed by the medical board. Since, the petitioner had already been referred to the medical board, it is only appropriate for the petitioner to await comprehensive report of the 4/6
medical board, for which the petitioner must also cooperate with the medical board namely the first respondent in W.P.(MD).No.25043 of 2025. If the petitioner fails to cooperate with the medical board, it would defeat the ability of the medical board to give its comprehensive report.
6. In the light of the above discussion, the writ petition in WP. (MD).No.25043 of 2025 is disposed of with a direction to the first respondent to give a comprehensive medical report and the petitioner shall cooperate with the medical board evaluation for and thereafter the 2nd respondent namely the Commissioner, Thoothukudi City Muncipal Corporation, shall take a decision on the claim made by the petitioner for retirement on the ground of consequence medical invalidation.
7. With the above directions, the WP.(MD).No.25043 of 2025 is disposed of and the W.P.(MD).No.27624 of 2025 is dismissed. No costs. 12.11.2025 NCC:yes/no Index:yes/no Internet:yes/no gvn 5/6
