PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certorari, to call for the records pertaining to R.O.No.227/2013, C.No.B1/5614/2013, dated 24.06.2013 passed by the 1st respondent and quash the same. ORDER
This Writ Petition has been filed to quash the order passed in R.O.No.227/2013, C.No.B1/5614/2013, dated 24.06.2013 by the first respondent.
2.The learned counsel for the petitioner would submit that the petitioner was appointed as Constable on 23.12.1985. Based on the complaint given by one J.Manikandan, a case in Cr.No.8 of 2013 has been registered against the petitioner and pursuant to the criminal case, the petitioner was placed under suspension by the first respondent by order dated 24.06.2013. After filing the charge sheet, the case has been taken on file in Spl.C.C.No.12 of 2014 by the learned Chief Judicial Magistrate, Kumbakonam. But, till date no witnesses were examined by the prosecution. Hence, the petitioner is before this Court for the relief as stated above. https://hcservices.ecourts.gov.in/hcservices/
3.The learned Additional Government Pleader appearing for the respondents would submit that if the petitioner made any representation to seek his remedy before the first respondent, the same shall be considered as early as possible on merits and in accordance with law.
4.Considering the facts and circumstances of the case and the submission made by the learned Additional Government Pleader, this Court is inclined to pass the following order: (i) the petitioner is directed to submit a representation before the first respondent within a period of one week from the date of receipt of a copy of this order and on receipt of the same, the first respondent is directed to pass appropriate orders within a period of twelve weeks therefrom; 5.This Writ Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petitions are closed.
