ORDER

Heard both sides.

2.The petitioner suffered an adverse order at the hands of the Sub Collector, Pudukkottai. Penalty to the tune of Rs.1,18,01,210/- was imposed on the petitioner for illicit quarrying. Aggrieved by the same, 2/6

the petitioner has filed an appeal before the first respondent. The petitioner does not appear to have obtained any interim relief at the hands of the appellate authority. In the meanwhile, the demand is sought to be enforced. The petitioner undertakes to pay a sum of Rs.10,00,000/- to the credit of Fines (&) Penalties 0853-00-107-AJ-22997 within four weeks without prejudice to his defence in the appeal. The first respondent is directed to dispose of the appeal on merits and in accordance with law within a period of five months from the date of receipt of a copy of this order. Till the first respondent disposes of the appeal, the impugned demand shall be kept in abeyance and put on hold. If the petitioner fails to remit the sum of Rs.10,00,000/- as undertaken by him, the benefit of this order would be automatically recalled. I have not gone into the merits of the matter.
