ORDER

The present Writ Petition has been filed seeking for a direction to direct the first respondent to conclude the disciplinary action initiated against the petitioner under rule-9 of the Tamil Nadu Pension Rules, 1978 within the time period stipulated by this Court.

2. When the matter is taken up for hearing today, the learned Special Government Pleader taking notice on behalf of the respondents 1 and 2 would submit that the enquiry officer had been appointed and the files are yet to be received from the Tribunal which had earlier directed proceedings to be initiated by the Department itself. Be that as it may, the disciplinary proceedings were initiated as against the petitioner as early as on 29.12.2022 and the same is being kept pending in spite of superannuation of the petitioner.

3. In view of the same, there shall be a direction to the first respondent to take necessary steps for disposing of the disciplinary proceedings initiated against the petitioner on merits and in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order.

4. The writ petition stands disposed of with the above direction. There shall be no order as to costs.
