Respondents Prayer: Civil Revision Petition filed under Article 227 of Constitution of India, against the decreetal order dated 25.10.2019 of the Motor Accidents Claims Tribunal of Kuzhithurai made in un-numbered E.A. in C.F.199 of 2015 in E.P.No.31 of 2015 in M.C.O.P.No.65 of 2010, with a prayer is set aside the same and further directing the said Tribunal to number the said E.A. and dispose of the same in accordance with law.

ORDER

On the side of the petitioner, it is stated that in M.C.O.P.No.65 of 2010 an award of Rs.5,35,000/- was granted to the share of the minor petitioner and the accrued interest should be withdrawn by the mother of the minor petitioner once in six months. But, the trial Court deposited that amount in the Court account and the mother of the petitioner has to apply to the Court each time to get the accrued interest amount and an order has to be passed by this Court, to direct the Execution Court to deposit the amount in the name of the minor petitioner in a Nationalised Bank, where the mother of the minor petitioner is having an Account, so that the mother of the minor petitioner can withdraw the accrued interest directly from the Bank once in six months for https://hcservices.ecourts.gov.in/hcservices/ 1/2

C.R.P(MD)No.2372 of 2019 Maintenance and Education of the minor petitioner.

2. Hence, the Execution Court is directed to number the petition and pass suitable orders within a period of two weeks from the date of receipt of a copy of this order, so that the accrued interest and arrears of interest will be credited to the Account of the Mother once in six months and the Mother of the minor petitioner/ Ushakumari can get the interest amount directly from the Bank.

3. With the above direction, this Civil Revision Petition is disposed of. No costs.
