Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, to direct the 2nd respondent to conduct an enquiry on the petitioner's representation, dated 18.03.2019 as accordance with law and to pass an order canceling the joint patta/Joint entry in Town Survey Land Register, stands in the name of the respondents 5 to 8 for his land, measuring 0.0168.5 Sq.mtr in T.S.No. 14/2 in Wad-C, Block No.18 (New Ward No.3) in Aruppukottai and to issue a separate patta in his name and register the same in Town Survey Land Register of the 4th respondent Municipality within a time to be fixed by this Court. 1/3

ORDER

This writ petition is filed for issuing a writ of Mandamus directing the second respondent to conduct an enquiry and to cancel the joint patta standing in the name of respondents 5 to 8. 2.However, the petitioner has produced before this Court the proceedings of the Tahsildar, modifying the earlier order passed by him earlier. Though the petitioner states that the patta has now been changed in favour of the petitioner in respect of two survey numbers, still the petitioner has grievance as there is some variation in the extent. Therefore, the petitioner also seeks leave of this Court to agitate his case before the appellate authority namely, the Revenue Divisional Officer.

3.In view of the same, this writ petition is disposed of with liberty to the petitioner to approach the second respondent who is the Appellate Authority under the Tamilnadu Patta Pass Book Act. No costs.
