Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the respondents 1 to 3 and 5 and the learned Additional Government Pleader appearing for the respondents 4 and 6. 2/5

2. Issuance of notice to the seventh respondent is dispensed with.

3. He alleges that in survey No.86/2, the seventh respondent has put up a building. The petitioner asserts that it has been classified as Odai. The classification of the said petition-mentioned survey number is conceded by the official respondents.

4. We direct the third respondent to instruct the jurisdictional Tahsildar to issue notice to the seventh respondent. Enquiry shall be conducted. If the Tahsildar is satisfied that the encroachment has been committed by the seventh respondent, action shall be taken to have the same to be removed. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs.
