PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to Re-issue the Passport based on the petitioner's application in File No.TR2075541685925, dated 22.08.2025 by considering the petitioner's representation dated 22.09.2025.

ORDER
The present writ petition has been filed seeking a mandamus as against the first respondent for reissuance of the passport based upon his application dated 22.08.2025.

The learned Government Advocate(crl.side) appearing for the second respondent submits that two criminal cases have been registered as against the petitioner in Cr.Nos.184 of 2014 and 185 of 2014 on the file of the second respondent herein. In both the cases, final report has been filed before the learned Judicial Magistrate, Pudukottai, on 11.12.2014. However, the same have not been taken on file. In view of the certain defects, charge sheets have been returned and so far they have not been re-presented by the police officials concerned.

3. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR is not a legal impediment for issuance of the passport.

Considering the fact that the charge sheet has not been taken on file for the past 11 years and so far, the police officials have not taken any steps to re-present the same, the first respondent is directed to pass order in the application presented by the petitioner for reissuance of the passport within a period of four weeks from the date of receipt of a copy of this order.
5. With the above said observations, this writ petition stands disposed of. No costs.
