ORDER : The Court made the following order :- The petitioner/Accused No.2 herein, who was arrested and remanded to judicial custody on 31.08.2023 for the alleged offence under Section 302 IPC in Crime No.346 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 30.08.2023, the petitioner herein along with other accused while they were consuming liquor, attacked the deceased with Aruval and caused his death and thereby, they committed the murder of the deceased. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner and deceased were friends and they used to consume liquor jointly and at that time, the deceased has abused filthy language about A1's mother and due to which there was a wordy quarrel arose between them and due to sudden provocation, the alleged occurrence took place. He further submitted that the petitioner is in judicial custody for the past 55 days. Accordingly, the learned Counsel prayed to grant bail to the petitioner.

4.The learned Additional Public Prosecutor submitted that while consuming liquor, the petitioner herein and the other accused had committed the murder of the deceased. He further submitted that investigation is almost completed and investigating agency is awaiting for visra report. He further submitted that the deceased involved various criminal cases and he used to take money from the accused for consuming liquor.

5. Heard on both sides. This Court has perused the records.

6. The petitioner is in judicial custody for the past 55 days. The petitioner has no previous case. Considering the nature of offence allegedly committed by the petitioner, considering the antecedents of the deceased and the stage of the investigation, this Court is inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is allowed subject to the following conditions:

(i) The petitioner is ordered to be released on bail, on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Thoothukudi; 3/5

(ii) The petitioner shall appear and sign before the respondent police daily at 10.30 a.m. and 5.30 pm until further orders;

(iii) The petitioner shall not cause threat to the defacto complainant and witnesses; and (iv) On breach of any of the aforementioned conditions, the learned Magistrate is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions are imposed by themselves as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs.
