By asserting that lands bearing Survey Nos. 226/3 and 264/6 stood in the name of the petitioner's grandfather Pachamuthu Konar and 1/4

that the petitioner's father Perumal succeeded to such lands and upon the death of the said Perumal, he is survived by twelve legal heirs, the present writ petition has been filed.

2. By referring to revenue records reflecting the name of Pachamuthu konar as the owner of the relevant lands, learned counsel also refers to the legal heirship certificate in relation to Perumal reflecting the names of twelve legal heirs, including the petitioner. Therefore he states that the petitioner is entitled to a joint patta.

3. Learned Special Government Pleader accepts notice on behalf of both the respondents. He submits that an inquiry would be conducted by the Tahsildar and orders issued on merits.

4. The revenue records produced by the petitioner reflect the name of Pachamuthu Konar in respect of Survey Nos.264/6 and 226/3. It is unclear as to how many legal heirs the said Pachamuthu Konar had. These aspects would have to be examined in course of inquiry. 2/4

5. Accordingly, without expressing any opinion on the merits, the petitioner is directed to submit a fresh application seeking joint patta and enclosing all relevant documents. Such application shall be considered and disposed of by the second respondent after providing a reasonable opportunity to the petitioner, the other legal heirs of Perumal and other legal heirs of Pachamuthu Konar. This exercise shall be completed within four months from the date of receipt of a copy of this order.
