PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to disburse the remaining amount of Rs.52.30/- lakhs as per the tender amount with accrued interest per annum to the petitioner.

ORDER

The present writ petition has been filed seeking a mandamus directing the respondents to disburse the balance bill amount of Rs.52.30/- lakhs as per the tender amount with accrued interest per annum to the petitioner.

2. Since the petitioner was not present on 19.01.2026, it is listed under the caption "for dismissal".

3. The learned Counsel appearing for the 4th respondent submitted that the entire bill amount has been cleared in favour of writ petitioner. He also relies upon paragraph No.4 of the counter, which is extracted as follows:- "It is humbly submitted that this respondent initially disbursed a sum of Rs. 31,96,850/- by way of Cheque date 23.06.2022 bearing Cheque Nos.000002, 000003 and 000001 to the petitioner. However, filed the present Writ 2/5

Petition complaining the non-payment of remaining amount. Pending Writ Petition, this respondent disbursed the remaining amount payable to the petitioner through RTGS i.e., on 16.02.2023. It is further submitted that the refundable deductions such as fixed security deposit and security deposit also paid by this respondent to the petitioner herein. Therefore, as on today there is no amount liable to be paid by this respond nt to the petitioner. Hence, present Writ Petition is liable to be dismissed."

4. Even today, there is no representation on the side of the writ petitioner.

5. In view of the above said facts, this writ petition stands dismissed. No costs.
