PRAYER :- For Bail petition in Cr.No.6 of 2019 on the file of the respondent.
ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner is arrayed as sole accused. He was arrested and remanded to Judicial Custody on 10.11.2019 for the offences punishable under section 5(m) r/w. 6 POCSO Act, in Crime No.6 of 2019 on the file of the respondent police. He seeks bail.
3. The case of the prosecution is that the petitioner who is the polytechnic college student had taken the victim girl to his house https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.19211 of 2019 and committed the offence in question. The statement of the victim girl was also recorded. The age of the victim girl is hardly six years. The defacto complainant is her grandmother.
4. Since the allegations made against the petitioner are fairly serious, I am not inclined to grant bail. This criminal original petition stands dismissed, accordingly.
5. The respondent is directed to file final report immediately and without any delay. The statement of the victim girl will also be recorded within a period of 30 days after taking cognizance of the offence. The petitioner can renew his bail petition only after the victim's evidence is recorded.
