P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order passed by the first respondent vide his proceedings in Na.Ka.No.656/2021/A2 dated 14.06.2022 and quash the same as illegal and in furtherance to direct the respondents No.1 and 2 to restore the patta stood in the petitioner's name in respect of the lands in Survey Nos.162/1, 162/2, 683/1, 686/1, 687/1A, 690/2 and 691 at Vedasandur Village, Vedasandur Taluk, Dindigul District and for other reliefs.

ORDER
The petitioner challenges the impugned order passed by the first respondent in Na.Ka.No.656/2021/A2, dated 14.06.2022.
2. Though the petitioner seeks restoration of patta in his name, considering the fact that the impugned order came to be passed without affording an opportunity to the petitioner, on such limited ground alone, without going into the merits of the other challenge to the impugned order, the order of the first respondent is set aside. The matter is remitted 2/5
to the first respondent to consider and pass fresh orders based on the available documents and other materials placed by the rival claimants including the fifth respondent, who approached the first respondent by application dated 19.02.2022, and also the writ petitioner and other interested parties, if any. The first respondent shall conduct necessary enquiry and pass final orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order, after affording a fair opportunity to all the interested parties.
3. With the above direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. Index : Yes / No NCC : Yes / No 05.03.2025 am 3/5
