O R D E R This Criminal Original Petition has been filed to call for the records pertaining to the Cr.M.P. No.493 of 2023 in SC.No.301 of 2022 on the file of the II-Additional District and Sessions Judge, Thanjavur, and set aside the same.

2. Now the grievance of the petitioner is that while cross examination is under way, an application was filed by the prosecution to recall P.W.1 to P.W.3 for further chief examination. By mistake, that petition was allowed on 29.09.2023 in Cr.M.P. No.493 of 2023 in S.C.No.301 of 2022 on the file of the II-Additional District and Sessions Judge, Thanjavur.

3. Since cross examination is not completed, let the above said order be kept in abeyance, till the cross examination of the witnesses is over. After that the order in Cr.M.P.No.493 of 2023 shall be executed. 2/4

4. With the above said direction, this Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed.
