ORDER

The petitioners seek to quash the impugned Charge Sheet in C.C. No.396 of 2020 on the file of the Learned Judicial Magistrate No.II, 1/9

Nagercoil, which was filed for the offences under Sections 294(b), 325 and 506(ii) of IPC.

2.The gist of the allegation in the final report is that on account of prior enmity, the petitioners attacked the defacto complainant with hands, caused injuries, criminally intimidated him with dire consequences and thus committed the aforesaid offences.

3.The learned counsel for the petitioners and the learned counsel for the defacto complainant/the second respondent would submit that the parties have now entered into a compromise on the advise of the elders and well-wishers and both the parties have agreed that the impugned final report may be quashed.

5.The petitioners, namely, Raasik @ Rasiq Mohamed (Aadhaar No.8231 9710 2749) and the second respondent, namely, Nawfalkhan (Aadhaar No.9927 2277 2149) are present before this Court in person. They are identified by Mr.R.Jeyakumar, Special Sub Inspector of Police, Kottor Police Station, Kanniyakumari District. All the parties confirmed the compromise arrived at between them.

6.Considering the nature of the offences and the fact that the parties have arrived at a compromise, this Court is of the view that no useful purpose would be served by keeping the impugned charge sheet pending trial. Accordingly, the impugned charge sheet in C.C. No.396 of 2020 on the file of the Learned Judicial Magistrate No.II, Nagercoil, is quashed. The petitioners shall pay a sum of Rs.10,000/- as costs to the Mediation and Conciliation Centre attached to the Madurai Bench of Madras High Court forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. 7/9
