PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the Respondents 4 and 5 to conduct auction in respect of 11 shops and one two wheeler stand situated at Patchaimalaiyankottai Village Panchayat, Nilakota Talk, Dindigul District as per Rule 3 of the Tamilnadu Panchayats (Procedure for Conducting Public Auction of Leases and Sales in the Panchayats) Rules 2001 by considering the petitioner's representation dated 11.07.2025 within a time stipulated by this Court. ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) Read this order in continuation of and in conjunction with order dated 21.11.2025.
2.An affidavit is filed by R5 and as far as Shop No.1 is concerned, it is stated at para No.4 as follows: "I respectfully submit that for the Shop No.1, the successful bidder has remitted the due amount in the following manner namely on 11.1.2022, Rs.75,000/- + Rs.75,000/- + Rs.2,73,180/- paid, on 26.7.2023 Rs.2,00,000/- paid, on 30.3.2023 Rs.1,30,425/- paid, on 11.4.2023 Rs.9,000/- paid and on 28.11.2024 Rs.3,48,180/- paid by the bidder and hence, the Shop No.1 alone the lease was extended." 3.As far as point '(iii)' is concerned, they merely state that effective steps are being taken to recover the arrears of rental amount. 2/4
We are unconvinced with the statement. We have been orally informed that action has been initiated under revenue recovery proceedings. 4.The quantification of arrears as sought for by us has not been made.
5.Additional status report be filed within a period of two weeks setting out the quantification of arrears and ensuring that recovery notices are issued within such time.
