ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent 1/3

police for the offences punishable under sections 294(b), 323, 324, 307, 506(ii) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.57 of 2023, on the file of the respondent police,,seeks anticipatory bail.

2. The case of the prosecution that due to land dispute on consuming alcohol the petitioner herein and other accused went to the house of the defacto complainant and attacked him with Arual and caused injury and also abused him in filthy language. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been false case has been foisted against him.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that it is a case and counter and and there is no previous case pending against the petitioner and the injured was discharged from the hospital. He would further submit that the investigation of the case is pending and hence, he strongly objected to grant anticipatory bail to the petitioner. 2/3

5. On a perusal of the Accident Register it is seen that the cut injury caused by the petitioner is very depth.

6. Considering the gravity of offence and also considering the nature of injury, this Court is not inclined to grant anticipatory bail to the petitioner.
