Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 534 of 2023 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under section 7(3) of Lotteries Regulation Act, in Crime No.534 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that when the respondent police was in routine check up, A1 and the petitioner herein illegally found in possession of 23 Nos of 1/3
Lottery Tickets worth about Rs.7,400/-. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that A1 and the petitioner herein have illegally found in possession of 23 Nos of Lottery Tickets worth about Rs.7,400/- and on seeing the police, the petitioner herein ran away from the place of occurrence. He would further submit that the petitioner herein is having 3 previous cases in similar nature and hence, he strongly opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of the case and also considering the serious nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
