ORDER

This Contempt Petition has been filed to initiate contempt proceedings, against the Contemnor/ Respondent herein and to punish her for the wilful disobedience of the order of the Writ Court, 1/5

dated 20.03.2024, made in WP(MD)No.18073 of 2021. 2.

This Court heard Ms.S.Sushmitha, the learned counsel for the Petitioner and Mr.D.Sadiq Raja, learned Additional Government Pleader for the Respondents.

The case of the Petitioner is that he had retired from service, as a Skilled Assistant on 29.06.2012, in the Respondent Panchayat Union. Since his retirement benefits were not settled, he had filed the above Writ Petition in WP(MD)No.18073 of 2021. The above Writ Petition was disposed of, by the order of the Writ Court, dated 20.03.2024, directing the Respondent herein/1st Respondent therein, to pass appropriate orders, on the proposal submitted by the 4th Respondent therein, dated 19.03.2024 and release all the pensionary benefits payable to the Petitioner, within a period of four weeks from the date of receipt of a copy of the order. Even thereafter, the Respondents did not disburse the retirement benefits to him. Hence, this Contempt Petition has been filed, seeking the relief, as stated above. 4.

Today, when the matter is taken up for consideration, the learned Additional Government Pleader for the Respondents has produced a copy of the order, dated 06.12.2024 passed by the Respondent herein and submitted that a copy of the said order dated, 06.12.2024 has 2/5

been furnished to the learned counsel for the Petitioner. The learned Additional Government Pleader further submits that the entire retirement benefits due to the Petitioner had already been made to him, as per the judgement and order of the Writ Court, dated 20.03.2024 passed in WP(MD)No.18073 of 2021 and that the Respondents have fully complied with the order of the Writ Court, dated 20.03.2024 passed in WP(MD)No.18073 of 2021. Thus, he further submits that as the entire retirement benefits had already been made to the Petitioner, there is no justification to pass any further order in the present Contempt Petition and accordingly, the same may be closed, discharging the Respondents from the present contempt proceedings.

The learned counsel for the Petitioner submits that she has received a copy of the order of the Respondent, dated 06.12.2024 and that the judgement and order of the Writ Court, dated 20.03.2024 made in WP(MD)No.18073 of 2021, has been fully complied with by the Respondents, by paying the entire retirement benefits due to the Petitioner. Thus, the learned counsel for the Petitioner submits that she has no objection if the present Contempt Petition is closed, by discharging the Respondents from the contempt proceedings. 3/5

After considering the arguments of the learned counsel for the parties and after perusal of the proceedings, dated 06.12.2024, passed by the Respondent, this Court is fully satisfied that the Petitioner had already been paid with the entire dues and that the Respondents have fully complied with the judgement and order of the Writ Court, dated, 20.03.2024 made in WP(MD)No.18073 of 2021. In view of the same, this Court deems it appropriate that no useful purpose would be served by keeping the present Contempt Petition pending. 7.

In view of the above, the present Contempt Petition is disposed of. The Respondents are discharged from the present contempt proceedings. The File is consigned to Record. There is no order as to costs.
