PRAYER :- For Anticipatory Bail in Crime No.61 of 2024 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.61 of 2024, for the offence punishable under Sections 354, 509, 502, 506(1), 499 of IPC and 66E and 71 of Information Technology Act, has filed this petition seeking anticipatory bail.

2. The allegation levelled against the petitioner is that the petitioner along with her husband had taken some obscene videos of the defacto complainant's daughter and used the same to intimidate her. The accused persons have also sent the videos to the groom of the defacto complainant's daughter and the marriage broker.

3. This is the 4th anticipatory bail application. Considering the nature of allegations, the earlier two applications filed by the petitioner along with her husband were dismissed by this Court, by orders dated 10.07.2024 and 16.08.2024 and the 3rd application filed by the petitioner was dismissed by this Court on 25.10.2024 2/5

It appears that in the earlier anticipatory bail petition filed by the petitioner along with her husband in Crl.O.P.(MD)No.10622 of 2024, this Court, by order dated 19.07.2024, granted interim anticipatory bail to the petitioner. Pursuant to the same, the petitioner appeared before the respondent Police for a period of two weeks for interrogation. However, the respondent Police has not collected any materials as against the petitioner. Further, the respondent Police has not taken any steps to arrest the petitioner for nearly five months, despite the dismissal of earlier three applications.

5. Since the respondent Police has not collected any materials as against the petitioner as on date, this Court is inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail in the event of arrest or on her appearance within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate on condition that (i) the petitioner executes a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the learned 3/5

Judicial Magistrate, Thirumayam.

(ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address; (iii) The petitioner shall appear before the respondent police daily at 10.30 a.m. for a period of 30 days and thereafter, as and when required for interrogation. She has to co-operate for the investigation.

(iv) The petitioner shall not misuse the liberty granted to her by indulging in any further offence and shall not tamper with the prosecution witnesses.
