The learned counsel appearing for the private respondents brings it to my notice that for the very same relief set out in the petition mentioned representation, the writ petitioner / M.Hariharan filed O.S.No.104 of 2018 before the First Additional Sub Court, Madurai. The said suit was dismissed on 25.04.2019. He fairly states that A.S.No.33 of 2019 has been filed before the First Additional District Judge, Madurai, challenging the same. Since the civil Court is seized of the matter, nothing survives for further adjudication in this writ petition. Since the petitioner has to pursue the remedy pending the first appeal, this writ petition is dismissed. No costs.
