PRAYER: Petition filed under Section 11 of the Contempt of Courts Act, 1971, praying to punish the respondent herein for willfully failing to comply with the orders dated 13.03.2017 made in W.P.(MD)No.4070 of 2012 on the file of this Court. Prayer in WP(MD). 4070/ 2012 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a WRIT OF MANDAMUS, directing the Respondents 1 to 4 herein to initiate appropriate action both under the provisions of HR & CE Act and the provisions of Indian Penal Code against the 5th Respondent herein for committing the offence of misappropriation from the temple funds of Sri Nirathalamudaya Ayyanar Sonaiya Temple, Manamadurai as evident from the audit report of the Regional Audit Committee of Hindu Religious & Charitable Endowment dated 09-082010, forthwith and consequently direct the Respondents 1 and 2 herein to recover the misappropriated amount from the 5th https://hcservices.ecourts.gov.in/hcservices/ Respondent belonging to Sri Nirathalamudaya Ayyanar Sonaiya Temple, Manamadurai.

ORDER

This Court earlier passed an order in W.P.(MD)No.4070 of 2012 dated 13.03.2017 directing the Joint Commissioner to issue notice to the individual trustees and conduct enquiry and take appropriate action. Since no order has been passed, the present contempt petition has been filed by the petitioner. 2.Today, when the matter is taken up for hearing, the learned counsel for the petitioner submitted that already the the action has been initiated and produced the copy of the proceedings of the respondent dated 30.01.2018 in e.f.vz;.2400/2017/,1>ehs; 30.01.2018.

3.In view of the above submission that the order has been complied by the Joint Commissioner, this Contempt Petition is closed.
