On 30.08.2017, this Court, taking note of the submissions made by the writ petitioner that the Athikulam Kanmai in Aruppukkottai has been seriously damaged and also considering the request to direct the second respondent to take action based on the first respondent's proceedings dated 09.10.2015, has directed the second respondent to take appropriate action in accordance with law which means to restore the Kanmai for fit to store water during the days of surplus for being used by the public. Accordingly, the respondent has taken action. However, alleging that no action has been taken, the present contempt petition is filed in the year 2018.

2. The second respondent has filed status report stating that the Kanmai is classified as Kanmai Poramboke as per the UDR-A Register. As per the inspection, dated 16.03.2018, major portion of the pits due to quarrying of gravel was covered and only in the water catchment area, small pits were available for drinking purpose for cattles. Thereafter, necessary action has been taken as per the direction of this Court and the Athikulam Tank been put to good condition and due to the recent copius rain, water is stored in the tank and being used by the public. Attributing motive for filing this contempt petition, the second respondent submitted that he has scrupuluously followed the direction of this Court and had made all possible measures to restore the tank, which is now filled with water.

The photographs furnished along with the status report also perused and this Court is satisfied that the order of the Court has been complied with and nothing survives in this contempt petition. Hence, this contempt petition is closed. Consequently, sub application also closed. [G.J.,J.] & [G.R.S.,J.] 20.12.
